Car Accidents and Cell Phone Use in Georgia

Each year, distracted driving claims over 3,000 lives in the United States. This represents about 8% of all fatal car accidents. According to the National Highway Transportation Administration, the most dangerous act of distracted driving is texting.

In response to these harrowing statistics, the Georgia legislature enacted the Hands-Free Distracted Driving Act in July 2018.  While driving, drivers are prohibited from:

  • Reading, writing or sending text message or emails
  • Taking photos or recording videos
  • Using the internet
  • Posting on a social media platform
  • Holding a phone in your hand or another part of your body

Under the law, you can be ticketed for using a “wireless telecommunications device” of any kind while driving. If you are caught violating this law, the penalties are as follows:

  • First Conviction – A $50.00 fine, and one point toward license suspension
  • Second Conviction – A $100 fine, and two points toward license suspension
  • Third and Subsequent Convictions – $150 fine, and three points toward license suspension.

A driver with 15 points in a 2-year period will have their license suspended in the state of Georgia. To qualify for a Points Reduction, you must complete a certified defensive driving course.

There are limited exceptions to this law, including using your phone to notify emergency responders of accidents, or using your phone with Bluetooth or wireless headphones to make or receive calls.
