Reckless Driving and Car Accidents

Georgia law defines reckless driving as driving with a “willful or wanton disregard for the safety of persons or property.” Driving under the influence of drugs or alcohol, speeding, ignoring traffic signs, weaving in and out of traffic, failure to yield, racing other vehicles, tailgating, and other dangerous driving behavior may be considered reckless driving.

In Georgia, reckless driving is considered to be a misdemeanor criminal offense punishable by up to 12 months in jail, or a fine of up to $1,000. The judge may impose other penalties, such as community service and/or completion of drug and alcohol programs.

If there are other charges involved, penalties will increase. For example, fleeing from an officer of the law will result in increased fines and jail time. If there is serious injury or homicide by vehicle related to reckless driving, this is likely to result in a felony charge.

There are many negative ramifications to a reckless driving charge, which stays on your record for life in Georgia. Your insurance rates will go up, and it could have an effect on your employment opportunities. A driver under age 21 who is convicted of a reckless driving charge will have their license automatically suspended.
