Georgia Statute of Limitations for Car Accidents

The Georgia statute of limitations, which sets the deadline for filing a lawsuit, is two years for car accidents. This is the same statute of limitations that applies for other personal injury and wrongful death actions. Regardless of the validity of your case, if you fail to file within the two-year limitation period, your claim will be time barred.

There are several exceptions to this statute of limitations. For example, if a minor child was involved in an accident, the two-year time period does not begin to run until the child turns 18 years old.
